1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website, platform, and services (collectively, the "Services") operated by Sculpt ("Sculpt", "we", "us", or "our"), a business in England and Wales. By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use our Services.

These Terms form a legally binding agreement between Sculpt and you, the individual consumer ("you", "your", or "user"). Sculpt provides its Services strictly for personal and non-commercial use. Sculpt does not ordinarily engage in business-to-business (B2B) arrangements. In the event that a business entity accesses our Services, it is deemed to have agreed to these same Terms without modification.

2. Scope of Services

Sculpt operates a digital analysis platform providing aesthetic and facial-structure assessments, visualisations, and general improvement recommendations derived from scientific and biometric methodologies. The Services are intended solely for informational, educational, and self-improvement purposes and are not a substitute for professional medical, dermatological, or psychological advice, diagnosis, or treatment.

  • You must be at least eighteen (18) years of age to use the Services.
  • You agree to provide accurate, up-to-date information, including photographic submissions that comply with our stated requirements.
  • You are responsible for maintaining the confidentiality of your account and any login credentials issued to you.
  • You agree not to use the Services for any illegal, defamatory, or infringing purpose.
  • Sculpt reserves the right to refuse, suspend, or terminate access if there is evidence of misuse or breach of these Terms.

3. User Submissions and Data Accuracy

Users must upload photographs that meet Sculpt’s submission standards. If images fail to meet the required quality for accurate assessment, Sculpt may request replacement images. By submitting photographs, you warrant that all uploaded material is your own likeness and that you have full rights to its use. You further grant Sculpt a non-exclusive, perpetual, royalty-free licence to process, analyse, and store your submissions for the purpose of fulfilling and improving the Services.

Sculpt does not guarantee accuracy or completeness in any analysis outcome. Facial metrics, proportions, and recommendations are derived using proprietary analytical processes which may incorporate manual and computational assessment. All interpretations and outputs are provided “as is” for personal use only.

4. Medical and Psychological Disclaimer

The Services, including all analyses, reports, visualisations, and recommendations, are not intended to constitute or replace medical, dermatological, psychological, or therapeutic advice. You should consult a qualified healthcare provider before acting on any suggestion derived from Sculpt’s reports or materials.

Sculpt disclaims all liability for any health condition, injury, reaction, or psychological distress arising from the interpretation or application of its reports. The inclusion of suggested products or treatments does not constitute endorsement or guarantee of efficacy or safety. All responsibility for use lies with the consumer.

By purchasing or using the Services, you acknowledge that results are inherently subjective and may vary between individuals. Sculpt makes no representation regarding achievable outcomes.

5. Payments, Fees, and Refunds

All payments are processed securely through Stripe and must be made in full at the point of purchase. By completing a transaction, you authorise Sculpt to collect the applicable fees as stated at checkout.

Sculpt operates a one-time purchase model. Once photographic or questionnaire data has been submitted, the service is deemed to have commenced, and you forfeit any statutory right to cancellation or refund except where required by the Consumer Rights Act 2015. Sculpt otherwise provides no refunds or exchanges under any circumstance.

In the unlikely event of a billing error, Sculpt reserves the right to investigate and, if appropriate, issue a corrective refund at its sole discretion.

6. Privacy, Data Retention and Security

Sculpt processes personal data in compliance with the United Kingdom General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018. By using our Services, you consent to the collection, storage, and use of your data, including photographs, annotations, edited images, and questionnaire responses.

Sculpt may retain uploaded and derived data indefinitely for operational, analytical, and quality-improvement purposes. While users retain ownership of their original photographs, Sculpt retains ownership of derivative works, including annotated or modified imagery. Sculpt may use anonymised or edited outputs for internal research, product development, or promotional activities, subject to applicable law.

Sculpt employs commercially reasonable administrative, technical, and physical safeguards to protect user data. However, no system is entirely immune from unauthorised access or compromise, and you acknowledge that submission of information is undertaken at your own risk.

7. Intellectual Property Rights

All intellectual property rights in Sculpt’s platform, technology, algorithms, reports, databases, code, text, graphics, and other materials remain the exclusive property of Sculpt. Users are granted a limited, non-transferable licence to use the Services for personal, non-commercial purposes only.

You must not copy, distribute, modify, decompile, or create derivative works of any part of Sculpt’s materials or platform without express written permission. Any unauthorised use constitutes a material breach of these Terms and may result in civil or criminal action.

8. Limitation of Liability and Indemnity

To the fullest extent permitted by law, Sculpt excludes all implied warranties and conditions relating to the Services. Sculpt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or anticipated savings, arising from or in connection with the use or inability to use the Services.

In no event shall Sculpt’s aggregate liability exceed the total amount paid by the user for the specific Service giving rise to the claim. Users agree to indemnify and hold harmless Sculpt, its directors, employees, agents, and affiliates from any claims, damages, or liabilities arising from breach of these Terms or misuse of the Services.

Nothing in these Terms shall limit or exclude liability for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation, as prohibited by UK law.

9. Electronic Communications

You consent to receive communications electronically from Sculpt, including transactional, operational, and legal notices, in accordance with the Electronic Communications Act 2000. All communications delivered electronically shall satisfy any legal requirement that such communications be in writing.

10. Force Majeure

Sculpt shall not be held liable for delay or failure in performance caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, labour disputes, governmental action, natural disasters, or technical failures affecting third-party networks or providers.

11. Severability and Entire Agreement

If any provision of these Terms is held to be unlawful or unenforceable, such provision shall be severed without affecting the validity or enforceability of the remaining provisions. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sculpt regarding your use of the Services and supersede any prior agreements or communications.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be resolved amicably through negotiation.

If settlement cannot be reached within thirty (30) days, the matter shall be referred to binding arbitration in London under the Arbitration Act 1996. The arbitration shall be conducted in English, and the decision of the arbitrator shall be final and enforceable in any competent court. Each party shall bear its own costs unless otherwise directed by the arbitrator.
